In the text of the decree, it is emphasized that there are serious problems in the area of state regulation of entrepreneurship, which negatively affect the development of business and its environment, as well as reduce the trust of entrepreneurs and the overall economic development of the country.
To improve the situation and create favorable conditions for business, it is proposed to introduce a temporary ban on inspections conducted by law enforcement and other authorized bodies until December 31, 2026. Exceptions will include inspections carried out in the following cases:
- within the framework of criminal and civil proceedings;
- upon requests from entrepreneurs when they are the subject of an inspection in accordance with the legislation of the Kyrgyz Republic;
- at the request of foreign state bodies;
- upon appeals from individuals and legal entities;
- based on media materials containing specific information about violations of the law by business entities;
- at the request of officials from state bodies and local self-government bodies in case of identifying facts of violations of legislation with supporting documents attached;
- by customs authorities during customs control;
- by tax inspectors.
If the decree is adopted, during the period of the moratorium, state control bodies will be required to conduct monitoring and provide consultations to entrepreneurs, ensuring compliance with legislation, clarifications, and recommendations, as well as identifying potential violations. Control will be carried out without conducting planned and unscheduled inspections.
Entrepreneurs will be obliged to facilitate monitoring and consulting by providing the necessary information and documents only within the framework of consultative support.
It is important to note that the provision of information will not serve as a basis for conducting inspections, imposing fines, or other sanctions during the period of the moratorium.
