
The appeal from the pensioner was related to the fact that her son, A.M., and daughter-in-law, O.Z., divorced in 2014 after six years of marriage. The children remained with their father, but they were raised by their grandmother.
Unfortunately, nine years ago they lost their father, and in 2024 their mother also passed away. As a result, the grandmother became the official guardian of the minors by a decision of the Naryn City Court.
Messages from social workers became a signal for the grandmother to take action, as land designated for agricultural use was registered in the name of her deceased daughter-in-law. She decided to formalize the plot in the name of her grandchildren as legal heirs, but faced opposition from her daughter-in-law's relatives, who attempted to contest the rights to the land and did not provide the necessary documents.
Employees of the Ombudsman Institute conducted a consultation, explaining the pensioner's rights and the procedure for appealing to the court.
According to Article 1142 of the Civil Code of the Kyrgyz Republic, the first-order heirs are children, spouses, and parents. Article 1159 of the Civil Code regulates the distribution of inheritance, which can occur by agreement of the heirs or, in the absence of such agreement, through the court.
After contacting the Ombudsman Institute, a request was sent to the Legal Aid Service of the Ministry of Justice, resulting in the appointment of a free lawyer for the woman.
Additionally, a request was sent to the regional branch of the State Agency for Land Resources, Cadastre, and Geodesy, which confirmed the existence of an agricultural land plot of 58 hundredths registered in the name of the minors' mother.
The representative of the Ombudsman assisted the pensioner in gathering the necessary documents, after which the grandmother filed a lawsuit in court.
Only after this did the party contesting the rights to the plot agree to a settlement.
As a result, the minors received a certificate of inheritance rights, which allowed them to register the land plot in their names.
