
The Ombudsman Institute reported that the ombudsman provided support to two orphans from Naryn in obtaining an inheritance that had long been withheld by relatives. A pensioner, K.G., approached the ombudsman representative in the Naryn region, asking to protect the inheritance rights of her grandchildren, aged 14 and 15.
In her appeal, the woman explained that her son A.M. and daughter-in-law O.Z. divorced in 2014 after six years of marriage. The children stayed with their father, but were actually raised by their grandmother.
Unfortunately, nine years ago they lost their father, and in 2024 their mother also passed away. The Naryn City Court officially appointed the grandmother as the guardian of the minors.
Social workers informed the grandmother that a plot of agricultural land was registered in the name of her deceased daughter-in-law. After receiving this information, the pensioner decided to formalize the land for her grandchildren as legal heirs. However, the relatives of the daughter-in-law began to oppose this, creating various obstacles and not providing the necessary documents.
Institute staff conducted a consultation with the pensioner, explaining her rights and the procedure for appealing to the court.
According to Article 1142 of the Civil Code of the Kyrgyz Republic, the first-order heirs include children, spouses, and parents.
Article 1159 of the Civil Code of the Kyrgyz Republic also states that inheritance should be distributed by agreement among the successors, and if no agreement is reached, the matter is considered in court.
After contacting the Ombudsman Institute, the woman was assigned a free state lawyer through the Legal Aid Service of the Ministry of Justice.
Additionally, a request was sent to the regional office of the State Agency for Land Resources, Cadastre, and Geodesy, which confirmed the existence of a 58-acre plot in Naryn in the name of the minors' mother.
The assistance of the ombudsman representative allowed the grandmother to gather all the necessary documents, after which she filed a lawsuit in court. As a result, the party contesting the land rights agreed to a settlement.
Ultimately, the minors received a certificate of inheritance rights, which enabled them to formalize the plot in their name.
The institute noted that Ombudsman Jamila Dzhamanbaeva emphasizes the importance of upholding children's inheritance rights. She added that protecting children's interests is a priority established by the country's Constitution and a key focus of the ombudsman's work.
