Judges May Be Granted the Right to Retire After Years of Service

The initiative of the presidential administration concerns granting judges the right to retire after a certain number of years of service. The draft law is already available for public discussion.

According to the initiators, a judge's work is associated with a high degree of responsibility and stress. A judge makes important decisions daily that affect people's lives, which requires concentration, emotional stability, and psychological resilience. Long-term work in such conditions can lead to burnout and deterioration of health.

Continuous conflict resolution, handling criminal cases, pressure from the public and participants in the process, as well as the inability to openly defend oneself – all of this creates significant psychophysiological stress that is incomparable to most civilian professions.

Moreover, judges are not allowed to engage in other types of activities, participate in politics, run a business, or publicly express their opinions. The possibility of early retirement will reduce the likelihood that a judge will continue to work solely for the sake of earning a living, even if they are tired or their performance has declined.

This enhances the independence and objectivity of judicial decisions, as judges will not have to fear financial difficulties after their careers end.

Additionally, early retirement may contribute to the renewal of the judiciary, allowing young professionals with modern knowledge and energy to fill the vacant positions. This, in turn, will promote the development of the judicial system and increase public trust. The presence of a mechanism for planned renewal of the judicial staff will help avoid sharp personnel shortages, representatives of the administration emphasize.

In light of the above, the initiator has proposed to establish the right to retire after a certain number of years of service for judges with at least 20 years of experience, regardless of reaching the general retirement age.
