Immunity from Crimes. Dastan Bekeshev Discusses Dangerous Amendments

Deputy Dastan Bekeshev drew attention in his Telegram channel to a draft law that will be discussed at a meeting of the Jogorku Kenesh. This draft law proposes amendments to several codes, including the Criminal Code and the Criminal Procedure Code.

Among the proposed innovations is the definition of recidivism of crimes.

Additionally, the document contains an amendment regarding immunity from criminal liability for certain actions. According to Bekeshev, the draft law could exempt from punishment those who commit actions under the pretext of protecting various aspects of security, such as constitutional order, the economy, information, and ecology.

“Thus, one could destroy private property, claiming that it is done for economic security. Hacking a bank account or email could also be justified as a measure to protect information. Moreover, even physical violence could be presented as a defense of the constitutional order. This is indeed a troubling situation,” noted Dastan Bekeshev, expressing his bewilderment that the Jogorku Kenesh Committee on Law and Order has already approved the draft law in the first reading. He emphasized that such changes could place the Criminal Code above the Constitution, creating dangerous precedents for committing crimes.
