In Parliament, Calls Were Made to Exclude Controversial Articles from the Scandalous Interior Ministry Bill

Today, the parliament discussed a draft law concerning amendments to a number of legislative acts of the Kyrgyz Republic, including the Criminal Code and the Criminal Executive Code.

Deputy Dastan Bekeshev called for the rejection of the Ministry of Internal Affairs' draft law, which proposes the restoration of the recidivism institution. He noted that the proposed changes put the Criminal Code in contradiction with the Constitution. "Within the framework of economic or information security, crimes can be committed, and this will not be considered an offense. We are essentially giving officials and law enforcement agencies the opportunity to justify their actions based on such goals as protecting the constitutional order or public order," he stated.

According to Bekeshev, this legislation contradicts the interests of citizens and is anti-people. "This draft law concerns all of us. It must be rejected without discussion. We cannot afford to grant immunity to officials. Such insane initiatives are unacceptable," he added.

Deputy Suyunbek Omurzakov reported that the committee of the Jogorku Kenesh on law and order recommended excluding Articles 18 and 50 of the Criminal Code from the draft law.

The disputes were caused by amendments to Article 18, which states that "an action or inaction that formally falls under the signs of a crime is not considered such if it does not pose a public danger." This article also includes actions taken in the interests of state security and safety.

Elvira Surabaldiyeva asked Deputy Minister of Internal Affairs Erkebek Ashirkhodzhaev whether the committee's recommendations had been taken into account. Ashirkhodzhaev stated that the discussion of the issues took place at the committee meeting, and an agreed version would be presented later.

Surabaldiyeva emphasized that there is a division of opinions among the population regarding the death penalty and the proposed articles. She called for the exclusion of these articles from the draft law, as it raises doubts about the transparency of law enforcement agencies' work.

Ultimately, the concept of the draft law was approved in the first reading, with the need for further refinement taken into account.
