The criminal case was opened under Article 283, which concerns "the illegal manufacture of drugs and psychotropic substances without the intent to distribute them," according to the Criminal Code of Kyrgyzstan.
As reported by K.M.'s relatives, in accordance with the court's decision from February 17, his detention was replaced with house arrest. The court process has also been temporarily suspended pending the results of the appointed expert examinations.
At the hearing, the defendant's lawyers presented two motions, which the court granted. The defense pointed to K.M.'s health condition and noted that the charges fall into the category of less serious crimes. The court agreed with the defense's arguments. Recordings from body cameras that captured the arrest were sent to Bishkek for acoustic and phonoscopic examinations.
Turmush reported that the incident occurred on October 1, 2024, in the village of Kok-Talaa in the Kadamjay district. According to the investigation, police officers came to K.M.'s house to check on alimony, but during the inspection of the yard, they discovered "a plant with a specific smell," which became the basis for initiating a criminal case under Article 283 of the Criminal Code.
K.M.'s relatives express dissatisfaction regarding the objectivity of the initial investigative actions. His wife claims that they were subjected to psychological pressure from the police, demanding a confession in exchange for "leniency." The defendant's sister also notes procedural violations during the investigation. Neighbors and close ones state that K.M. has never been involved in criminal activity.
Despite the seriousness of the charges, K.M.'s family views the current progress of the case positively, emphasizing the professionalism and impartiality of the judge, who decided to thoroughly review the video recordings. It is expected that the court proceedings will resume after receiving official conclusions from Bishkek.
