According to the materials published in the State Register of Judicial Acts, Kamil [name changed M.K.S.] was brought to trial on charges of a crime that occurred in September 2024 in Uzgen. He gained the trust of resident U.B.H. and claimed that he had won a car at an auction in Dubai (United Arab Emirates) and was currently organizing its delivery to Uzgen. He asserted that he had previously engaged in similar activities.
According to the investigation, taking advantage of the victim's trust, he demanded 3,999,500 soms (47,500 dollars) from her to purchase a 2022 BMW X7. After receiving the money, he showed her photos and videos confirming the win of the car at the auction and its handover for delivery. However, later he sold the car to another buyer. As a result, under various pretexts, he paid only part of the amount, totaling 2,737,000 soms, absconding with the remaining 1,262,500 soms.
The victim suffered significant material damage amounting to 1,262,500 soms.
By the verdict of the Uzgen District Court of the Osh Region, delivered on July 28, 2025, S.M.K. was found guilty under part 3 of article 209 ("Fraud") of the Criminal Code and sentenced to 3 years of imprisonment in a general regime correctional colony.
The term of serving the sentence began on June 13, 2025. In accordance with part 5 of article 80 of the Criminal Code, one day of detention was equated to two days of imprisonment until the verdict entered into legal force. The measure of restraint remained unchanged.
The verdict issued by the judicial panel on criminal cases of the Osh Regional Court on September 29, 2025, upheld the decision of the Uzgen District Court, and the appeal was not satisfied.
The Judicial Panel of the Supreme Court on November 24, 2025, decided to annul the verdicts of the Uzgen District Court dated July 28, 2025, and the Osh Regional Court dated September 29, 2025, concerning S.M.K.
In accordance with paragraph 13 of part 1 of article 27 of the Criminal Procedure Code of the Kyrgyz Republic, the criminal case against S.M.K., accused under part 3 of article 209 of the Criminal Code, was terminated due to the reconciliation of the parties.
The Supreme Court also ordered the immediate release of S.M.K. from places of imprisonment. The cassation appeal of the lawyer was granted. This decision is final and not subject to appeal.
