The Collegium of the Jalal-Abad Regional Court reviewed the decision in the case of the murder of a teenager in the Nooken district, increasing the sentence for the accused to 12 years of imprisonment.

According to the case materials, on the night of August 25 to 26, 2023, B.K.S., a resident of the Nooken district, fired a shot from a "MOSSBERG-930" hunting rifle towards a group of teenagers in the village of Shaidan. As a result of this incident, 15-year-old M.E.T. (name changed) sustained a fatal gunshot wound to the head and died in the intensive care unit unconscious.

Initially, the Nooken District Court qualified the actions of the accused as murder under a lesser charge, sentencing him to 8 years of imprisonment. However, the prosecutor appealed this decision, pointing out the incorrect legal qualification and that the shooting posed a threat to the lives of several people.

Witnesses to the incident, E.T. and D.T., confirmed that they were at the scene. They stated that they were sitting with the victim when B.K.S. drove up in a car and began to take out a weapon. Hearing shouts of "they're shooting, run," they tried to escape, but B.K.S. shot in their direction without reason, after which he drove away. Later, they saw that Erkin was lying on the ground, and while trying to help, they noticed that he had been shot in the head. E.T. also reported that his uncle O.T. took the victim to the hospital.

In his testimony, the accused claimed that on the night of August 25, seeing E.T. with several people, he returned home, took the "MOSSBERG-930" rifle and ammunition, and then went to the place where the incident occurred. He loaded the weapon and fired towards E.T., but the bullet ricocheted and hit Erkin, leading to his death.

According to B.K.S., he did not intend to kill and only wanted to scare the opponent who was threatening him.

Nevertheless, the court concluded that the district court incorrectly assessed B.K.S.'s actions, as he deliberately left his home with a weapon and ammunition and fired at a group of people.

As a result, the appellate collegium found the sentence handed down by the Nooken District Court on June 9, 2025, to be unjustified and issued a new ruling recognizing the accused as guilty with an appropriate punishment.

On November 24, 2025, the appellate collegium of the Jalal-Abad Regional Court agreed with the prosecution's arguments, stating that B.K.S. consciously used a firearm and understood the possible consequences of his actions. The defense's arguments regarding the accidental nature of the incident were deemed unconvincing.

Thus, the sentence was changed: the actions of the accused were requalified as murder committed in a manner threatening the lives of many people, and he was sentenced to 12 years of imprisonment under Article 122 part 2 point 6 of the Criminal Code of the Kyrgyz Republic. The defense's appeals were rejected.
