Homeless Man Climbs into Someone Else's Car and Sets It on Fire While Trying to Keep Warm. He Was Convicted.

In Bishkek, a homeless man was convicted for setting a car on fire to keep warm. The sentence was published on the "Digital Justice" portal.

The man, known as Maxim, was found guilty of a property crime. According to the case materials, lacking permanent housing, he saw a car belonging to Nazar and entered its interior. To warm himself, he set fire to some paper, which caused a significant amount of smoke. After that, Maxim left the vehicle and fled the scene. As a result of the man's actions, the victim suffered substantial material damage amounting to 550,000 soms.

During the pre-trial investigation, Maxim's actions were classified under part 2 of article 216 of the Criminal Code of the Kyrgyz Republic, which concerns the destruction or damage of someone else's property causing significant harm, committed by arson or another dangerous method.

Disagreeing with the verdict, Maxim filed an appeal, claiming that he did not set the car on fire and, therefore, did not cause any material damage. He referred to physical evidence in the form of a CD, which shows that another person, not him, left the scene on a bicycle.

During the court hearing, Maxim partially admitted his guilt and explained that on that day he was in a state of severe alcohol intoxication, having consumed alcoholic beverages with friends, and he poorly remembers the details of what happened.

The victim, Nazar, reported that his neighbor noticed someone opening his car but assumed it was the owner himself. One of the rear doors of the car did not lock. Nazar also saw a video recording showing the accused parking his bicycle, approaching the car, and getting inside by opening the rear door.
