Man Opens Fire on Car with Child — Initially Only Fined

On October 20, 2025, the Supreme Court of the Kyrgyz Republic reviewed the verdict in a case related to a road conflict during which gunfire occurred, and deemed the previously imposed punishment insufficiently strict.


According to the investigation, on March 14, 2025, a resident of the Aravan district of the Osh region, J. A. (name changed - Jaloliddin), became involved in a road conflict on the Osh-3000 street in the Dostuk rural district. While driving his "DAEWOO Tico" car, he got into an argument with another participant. During the conflict, Jaloliddin fired several shots from a gas-traumatic pistol at the victim's car, shattering one of the windows, and then fled the scene. The victim's minor daughter was in the car. The damage caused by the incident amounted to 2,000 soms.
The Aravan District Court on June 3, 2025, and the judicial panel of the Osh Regional Court on July 23, 2025, found Jaloliddin guilty but limited the punishment to a fine of 700 calculated indicators (equal to 70,000 soms). The victim disagreed with this decision and filed a cassation appeal, demanding actual imprisonment for the offender.
Jaloliddin is a citizen of Kyrgyzstan, has a secondary education, is unmarried, unemployed, and has no prior convictions.
During the consideration of the cassation appeal, the Supreme Court noted that the lower courts did not fully take into account the public danger of Jaloliddin's actions and the nature of the crime committed. The court pointed out that the shots were fired from gas-traumatic weapons, while a minor girl was in the car, which led to damage to the car's body and windshield, as well as to the moral suffering of the victim and his daughter.
In making its decision on punishment, the court is obliged to consider the proportionality of the punishment to the degree of guilt and the severity of the harm caused. The Supreme Court concluded that the imposed fine did not meet the goals of justice and the principle of fairness.
Considering all the aforementioned circumstances, the judicial panel decided that Jaloliddin should be punished under paragraph 3 of part 2 of Article 280 of the Criminal Code of the Kyrgyz Republic (for hooliganism with the use or attempted use of firearms, gas-traumatic weapons, knives, brass knuckles, and other objects intended to cause harm to health) in the form of imprisonment for a term of three years.
