Sadyr Japarov Exempted International Events from the Public Procurement Law

The President of the Kyrgyz Republic, Sadyr Japarov, has signed a draft law that amends the law on public procurement. This was reported by the information policy department of the president's office.

The document was approved by the Jogorku Kenesh on January 22 of this year.

According to the amendments, the main goal is to increase the efficiency of budget funds used for the procurement of certain goods, works, and services.

Now, procurements related to the organization of international events held at the state level will not be regulated by the law on public procurement. This applies to events involving the president, the speaker of the Jogorku Kenesh, and the chairman of the cabinet of ministers, as well as visits by foreign leaders and delegations.

For such procurements, civil law contracts will be applied, which are concluded between the customer and the contractor in accordance with the civil law of the Kyrgyz Republic.

Additionally, the new law introduces the concept of "state assignment." It includes orders financed from the republican and local budgets to legal entities with state participation that perform key tasks to ensure economic stability and cultural development.

Procurements under the state assignment will also not fall under the law on public procurement and will be formalized through civil law agreements between the customer and the contractor, specifying the necessary indicators.

The law also establishes responsibility for both the state customer and the contractor for the targeted use of budget funds.

All changes are aimed at improving the procurement process in certain sectors funded by the budgets of the republic and local authorities.
