The Ministry of Transport clarified the warranty obligations of contractors in road construction

At the meeting of the "Adilet Kyrgyzstan" deputy group, held on January 30, Deputy of the Jogorku Kenesh Gulnara Akimbaeva asked Deputy Minister of Transport Beknazar Bazaraliev a question regarding the warranty period established for the construction and reconstruction of roads in Kyrgyzstan.
The Deputy Minister reported that for reconstructed roads, the warranty period is three years, while for new roads it is extended to five years. During this period, the deposit provided by the construction company is kept at the Ministry of Transport in the form of a bank guarantee.

“For five years after the completion of construction, the company's deposit remains with the Ministry of Transport. If no defects are found during the operation of the road, the funds are returned at the end of the warranty period,” Bazaraliev explained.
In the event that defects are discovered during the operation of the road, the contractor is obliged to rectify them at their own expense.
“If the company refuses to carry out the work to correct the defects, the ministry has the right to withhold the necessary amount from the bank guarantee,” the Deputy Minister added.

Akimbaeva also inquired about the measures taken against contracting organizations in the event of violations. In response, Bazaraliev stated that during inspections, a list of identified deficiencies is compiled and sent to the contractor for rectification.

“I do not recall instances where we have collected funds from the bank guarantee. However, there have been moments when contracting organizations rectified deficiencies within the framework of their warranty obligations,” he concluded.
