The Supreme Court Discussed Issues of Cybersecurity in the Judicial System

On February 4, a meeting was held at the Supreme Court of the Kyrgyz Republic, where issues of cybersecurity in the judicial system were discussed.

Inara Gilyazetdinova, a judge of the Supreme Court and chair of the working group on the digitalization of the judicial system, raised important questions related to legal liability in the event of data breaches, access management to court IT systems, workplace protection, video surveillance systems, as well as physical access control and response to various incidents.

Particular attention was paid to the insufficient clarity in delineating the powers and responsibilities among the involved agencies and officials.
There was also an emphasis on the need to create a transparent accounting of user actions, access control and data copying, as well as developing effective incident response mechanisms, backup procedures, and protecting the integrity of databases. Issues of interagency cooperation, conflict resolution, and confidentiality were also reflected in the discussion.

Ruslan Myrzalimov, advisor to the chairman of the Supreme Court, noted that in the context of increasing hybrid threats, cybersecurity of the judicial system becomes crucial from institutional and constitutional perspectives, as it directly affects the guarantees of judicial independence and the protection of the rights of participants in judicial proceedings.

“Judicial independence implies not only the organizational and functional autonomy of judges but also the protection of information related to judicial activities. In the context of digitalization, any unauthorized interference in judicial information systems can affect the content of cases and the timelines for their consideration, as well as create opportunities for external pressure on judges and undermine trust in judicial decisions,” he added.

“Cybersecurity of the judicial system should be viewed as a key legal and institutional guarantee of judicial independence, rather than just a technical element,” emphasized Myrzalimov.
According to the presidential decree on improving digital transformation in public administration, the material and technical base of the information technology "Adilet Sot" has been transferred to the JSC "Tunduk".

Thus, "Tunduk" as the operator of the digital infrastructure will be responsible for the reliable functioning of the court information systems, data protection, and prevention of cyber incidents. The company must ensure the preservation and integrity of data, uninterrupted operation of information resources, as well as establish a transparent monitoring and accountability system in cooperation with the judicial department and other government agencies, including the State Institution "Ukuq" under the General Prosecutor's Office, which has been entrusted with the technical infrastructure of the judicial system.

A representative of the State Institution "Ukuq" expressed confidence that the existing infrastructure will be maintained at a proper level.
