Fake Pregnancy for Citizenship. A Man Sentenced in Bishkek

According to information presented on the "Digital Justice" portal, a man was convicted in Bishkek for inciting the forgery of an official document.

Names have been changed. In August 2023, Tilek visited gynecologist Zhibek at one of the family medicine centers in the capital, providing a passport in the name of Saniya and an ultrasound conclusion. He stated that Saniya was his daughter and persuaded the doctor to issue a pregnancy certificate for a fee of 500 soms.

Zhibek, seeking to gain from the situation, did not enter the data about the examination into the medical record form 027/u. Instead, she registered Saniya in the accounting card without recording her in the pregnancy journal and without examining her, issuing a knowingly false pregnancy certificate.

After receiving the certificate, Tilek presented it at the civil registry office to quickly register a fictitious marriage between Saniya and a citizen of Russia, which would allow the latter to obtain Kyrgyz citizenship.

In his cassation appeal, the convicted individual stated the need to overturn the decisions of the lower courts and terminate the case due to the expiration of the statute of limitations.

According to Zhibek's testimony, Tilek approached her with a request to issue a pregnancy certificate because his daughter was planning to go abroad. The doctor issued the document based on the ultrasound but did not register the patient. She does not remember the details of the payment for the certificate, and Saniya's passport was handed to her personally by Tilek.

According to the doctor, if she had known that the certificate was intended for the civil registry office, she would not have issued it.

Saniya confirmed that she entered into a fictitious marriage with a citizen of Russia, which, as she was told, would last six months, after which they would have to divorce. She was promised a payment of one thousand dollars. At the same time, the woman claims that she was not pregnant by the Russian and only saw the doctor during the investigation.

The Supreme Court rejected the convicted individual's arguments for terminating the criminal prosecution due to the expiration of the statute of limitations, as the statute of limitations for such crimes is three years, and the verdict came into effect before its expiration. The judges found no grounds for closing the case.
