In Kyrgyzstan, there is a norm of 0.3 permille of alcohol in the blood, but not everyone is aware of it.
During the discussion, Deputy Minister of Internal Affairs Oktobur Urmanbetov confirmed that this norm indeed exists. He noted that the resolution adopted by the Cabinet of Ministers in 2015 officially established the threshold of 0.3 per mille in the rules for medical examination.
From the document: In cases where the person being examined shows no signs of acute alcohol poisoning and there is no evidence of alcohol consumption, and the results of laboratory tests indicate a blood alcohol level not exceeding 0.3 percent, this result cannot serve as a basis for establishing the fact of alcohol consumption or a state of acute intoxication.
Deputy Dastan Bekeshev expressed surprise that many citizens of Kyrgyzstan are unaware of this norm. He proposed to enshrine the threshold of 0.3 per mille at the legislative level, as has been done in Russia and Kazakhstan.
“The concept of 'state of intoxication' is currently vague. A person may have consumed alcohol the day before, and today they are sober, but the smell or remnants of alcohol may remain. Or, for example, a person drank kefir or took medication, and the breathalyzer shows the presence of alcohol. As a result, the driver may be mistakenly recognized as drunk,” he emphasized.
Bekeshev noted that this is a matter of serious responsibility. According to him, under the proposed changes, the fine for driving under the influence could amount to 80,000 soms with the revocation of driving rights. He believes that a clear definition of the threshold at 0.3 per mille in the law will help protect drivers from unjust penalties.
