Names have been changed.
On the defendants' bench were Kyrgyzstani Erkin and Uzbek Mustafa. The investigation established that in April 2024, the former handed over hashish to the latter near a car wash in one of the city’s neighborhoods, receiving money for it in an electronic wallet. Subsequently, Mustafa sold the drug to third parties.
In May and June of the same year, Erkin again sold hashish to Mustafa, who, in turn, resold it again.
- The Oktyabrsky District Court found Erkin guilty under part 1 of Article 282 of the Criminal Code of the Kyrgyz Republic "Illegal manufacture of narcotic drugs, psychotropic substances, and their analogs for the purpose of sale." He received a sentence of six years of imprisonment in a general regime correctional colony but was released from serving the sentence under probation supervision for four years.
- As for Mustafa, he was also found guilty under the same article. The court sentenced him to six years of imprisonment in a general regime correctional colony. Later, the Bishkek City Court changed the sentence, sending him to a strict regime colony and ordering his expulsion from the country. The other parts of the sentence remained unchanged.
The judicial panel of the Supreme Court noted that there was no evidence of prior conspiracy between the convicts in the case materials, and each acted independently. Thus, their actions were correctly qualified.
The court also emphasized that confiscation of property was not applied when sentencing, which contradicts the sanctions of the specified article.
As a result, the Supreme Court changed the sentence:
- Erkin was sentenced to six years of imprisonment with confiscation of property in a general regime correctional colony.
- Mustafa also received six years of imprisonment with confiscation of property, but in a strict regime correctional colony.
