Erkin, convicted of misconduct, knew that the land in the Sokuluk district was rented, but in June 2023, threatening Musa, the tenant, he illegally mowed clover, collecting about a thousand bales.
After that, he mowed clover again, baled 400 bales, and sold them, causing Musa damage amounting to 560,000 soms.
When Erkin threatened again while mowing clover on the same plots, Musa contacted the police, which prevented him from collecting the hay.
Subsequently, Erkin came to the field with a knife and, threatening, cut the strings of 1,080 bales belonging to Musa, causing damage of 47,000 soms.
Additionally, knowing that the plot belonged to Alan, he also unlawfully mowed clover that same month, baled 220 bales, and threatened physical harm. Later, he mowed clover again, collecting 300 bales, and took them, causing damage of 208,000 soms.
Also, threatening with a knife, he cut the strings of 220 bales of hay belonging to Alan, resulting in damage of 11,500 soms.
- The Sokuluk District Court found Erkin guilty of fifteen crimes under part 2 of Article 214 of the Criminal Code of the Kyrgyz Republic and sentenced him to five years in a general regime colony. However, he was granted probation supervision for three years.
- The Judicial Panel on Criminal Cases of the Chuy Regional Court upheld the sentence.
Furthermore, the victim Alan reported that he had rented his land to the LLC "Ch." for a long time, where alfalfa seeds had been sown by the previous tenant, and there were no conflicts with Erkin regarding the boundaries, raising questions about the legality of his actions.
The Judicial Panel of the Supreme Court, having reviewed the cassation appeal and studied the case materials, left the sentences unsatisfied.
