
The draft law was presented for public discussion by the president's administration
In Kyrgyzstan, the issue of the need to tighten punishments for the rape and murder of women and children has been raised again. The relevant draft law has been put forward for public discussion by the country's presidential administration.
The authors of the initiative noted the increasing number of serious crimes against vulnerable groups, which raises serious concerns in society and reflects the state of public safety.
“Protecting the rights of women and children is an important issue. Official statistics do not show the full picture. The number of cases of violence is increasing, and many crimes remain unregistered,” emphasize the developers of the draft law.
According to their opinion, the facts of violence published in the media have become commonplace, and society no longer reacts to them with the necessary alarm. “It is necessary to establish clear boundaries beyond which individuals committing violent acts must be excluded from society, and only harsh but fair punishments can ensure this,” they add.
As part of the new draft law, it is proposed to establish life imprisonment with property confiscation as punishment for the following particularly serious crimes:
- murder related to rape or other forms of violent sexual gratification (paragraph 8 of part 2 of article 122);
- rape committed against a person under the age of fourteen or a person with a disability (part 4 of article 154).
The initiators also propose to abolish the statute of limitations for murders in the following cases:
- murder of two or more persons;
- murder of a pregnant woman;
- murder of a person in a helpless state or a child;
- murder in connection with professional activities or the performance of public duty;
- murder committed out of hooligan motives;
- murder committed in a manner dangerous to the lives of many people;
- murder with particular cruelty;
- murder related to kidnapping or hostage-taking;
- murder associated with robbery, extortion, or terrorist acts;
- murder on the grounds of racial, ethnic, national, religious, or interregional enmity;
- murder for hire or for selfish motives;
- murder for the purpose of obtaining organs or tissues from the victim;
- murder committed to conceal another crime;
- murder by a group of persons or by prior conspiracy;
- murder committed by an organized group;
- murder as part of a criminal community;
- murder associated with rape or violent sexual gratification in other forms.
It is worth recalling that earlier in the country, the issue of restoring the death penalty for serious crimes against women and children was discussed; however, the Constitutional Court rejected this initiative.
