
Deputies are concerned about possible "immunity" for officials
In the Jogorku Kenesh, a discussion was held on the bill of the Ministry of Internal Affairs aimed at restoring the institution of recidivism. This bill proposes to tighten penalties for individuals with previous convictions, as well as to introduce confiscation of property for certain offenses.
The main goal of the initiative is to combat organized crime and prevent repeat offenses. According to the new provisions, recidivism will be considered intentional crimes committed by individuals who already have convictions for similar acts. Stricter measures are provided for such offenders: the minimum sentence will be increased, parole and probation will not be applicable, and for particularly dangerous recidivists, the punishment may reach nearly the maximum level.
Furthermore, the bill clarifies the responsibility for actions aimed at protecting the state, security, or constitutional order. The authors of the initiative argue that this is necessary to safeguard sovereignty, rights, and the safety of citizens. However, these provisions raised questions among the deputies.
Deputy Dastan Bekeshev expressed the opinion that some articles place the Criminal Code above the Constitution. "We are allowing actions that formally fall under criminal liability to be justified by referring to the protection of economic, informational, or environmental security. Such a bill contradicts the interests of citizens and should be rejected," he noted.
The Committee on Law and Order recommended excluding Articles 18 and 50 of the Criminal Code from the bill, which allow crimes to be justified by actions in the interests of the state. Deputy Elvira Surabaldiyeva emphasized that these norms cause disagreements in society and called for their exclusion.
At the same time, the initiators of the bill insist that the introduction of the recidivism institution is necessary to prevent repeat crimes, combat organized crime, and strengthen law and order. According to their data, after the abolition of recidivism, the level of repeat crimes among convicts reached 88-89%, and many of them were committed by groups.
The concept of the bill was approved in the first reading with the condition of further refinement and agreement on contentious points. The discussion of the bill will continue to find a balance between tightening responsibility and protecting the rights of citizens.
