In Aksy, a man accused his wife of having an intimate relationship with his older brother. She doused him with gasoline and set him on fire.

The court sentenced a woman convicted of attempting to murder her husband to 4 years in prison. The case went through three judicial instances.

According to data from the State Register of Judicial Acts, the incident occurred on March 28, 2025, at approximately 21:30. The investigation established that Batyr [name changed], the husband of the accused, returned home in a state of alcohol intoxication. As a result, a conflict arose during which the man accused his wife of having an affair with his older brother (kaymaga) and attempted to use force.

In response to her husband's aggression, Takhmina [name changed T.M.H.] took a plastic bottle of gasoline parked near the house and doused her husband with it, after which she set him on fire using matches. The man survived; however, Takhmina's actions were classified as attempted murder.

On July 21, 2025, the Aksy District Court found Takhmina guilty under Articles 37 and 122 Part 1 (Attempted Murder) of the Criminal Code and sentenced her to 8 years of imprisonment in a general regime colony, starting from April 28, 2025 (one day in pre-trial detention counts as two days in the colony).

On September 22, 2025, the Jalal-Abad Regional Court upheld the first-instance verdict, rejecting the defense's arguments.

Takhmina's lawyer filed a cassation appeal to the Supreme Court, requesting the annulment of the verdict or a deferral of the sentence until the youngest child turns 14 years old. The defense presented several factors:

- the presence of systematic violence, beatings, and humiliation from the husband over a long period;

- the state of intoxication of the victim during the conflict;

- the fact that Takhmina is raising three minor children almost alone.

After reviewing the case and hearing from both parties, the Supreme Court partially granted the lawyer's appeal on February 11, 2026.

The court amended the sentences of the Aksy District and Jalal-Abad Regional Courts in Takhmina's case. Applying Article 75 (Imposition of a More Lenient Sentence) of the Criminal Code, the Supreme Court reduced the prison term from 8 to 4 years.

In all other respects, the sentences remained unchanged. This decision is final and not subject to appeal.
