In recent days, the issue of creating an interagency commission to review criminal cases investigated by the GKNB over the past five years has been increasingly raised in public discussions. The special service responded to this proposal:
There is an established legal procedure.
According to the Constitution of the Kyrgyz Republic, the foundations of state power lie in the separation of functions and powers of various state bodies.
In accordance with criminal procedural legislation, oversight of the legality of investigations conducted by investigative units (such as the GKNB, the Ministry of Internal Affairs, etc.) is carried out by the prosecutor's office, while justice is entirely under the jurisdiction of the judicial authorities.
It is important to emphasize that according to Article 8 of the Criminal Procedure Code of the Kyrgyz Republic, the review of sentences and other court decisions in criminal cases is possible only within the framework established by the criminal procedural code, and procedural decisions made by investigators can only be overturned by a supervisory authority.
In this regard, the initiative to create a commission for the review of criminal cases contradicts constitutional principles, as the legislation clearly prohibits interference in the investigative and judicial process.
Furthermore, at the direction of the President, a reform is being implemented in the GKNB that encompasses almost all aspects and methods of its work.
The reform of the GKNB KR is aimed at improving its operations to adapt to modern challenges and threats, enhancing intelligence and counterintelligence activities, combating terrorism and extremism, eradicating corruption, suppressing organized crime, as well as ensuring the information and economic security of the country.
The GKNB conducts its activities strictly within the framework of the law, respecting the rights and freedoms of citizens guaranteed by the Constitution.
