The GKNB opposed the revision of criminal cases through commissions

The State Committee for National Security (SCNS) commented on the initiatives to form an interdepartmental commission that is supposed to review criminal cases investigated over the past five years.

Representatives of the security service pointed out that the current legislation clearly outlines the procedures for checking and reviewing criminal cases.

According to the Constitution of the Kyrgyz Republic, power is divided among various bodies, each with its own functions and authorities. Oversight of the legality of investigations conducted by investigative bodies (including the SCNS and the Ministry of Internal Affairs) is carried out by the prosecutor's office, while justice is the prerogative of the courts.

The SCNS also reminded that, in accordance with Article 8 of the Criminal Procedure Code of the Kyrgyz Republic, only courts have the right to check and review judicial decisions. Procedural decisions made by investigators can be challenged and revoked by supervisory bodies.

In this regard, the committee believes that the establishment of commissions to review criminal cases would contradict the fundamental principles of the Constitution, as the legislation explicitly prohibits interference in the investigative and judicial process.

Furthermore, the agency reported on a large-scale reform being implemented at the direction of the president. This reform covers all aspects of the SCNS's work and aims to adapt the national security bodies to modern challenges, including improving intelligence and counterintelligence activities, combating terrorism, extremism, corruption, and organized crime, as well as ensuring the information and economic security of the country.

The SCNS emphasizes that all actions of the agency are carried out in strict accordance with the law and with respect for the rights and freedoms of citizens enshrined in the Constitution.
