In response to these initiatives, the GKNB emphasized that there is a legally established procedure according to which state power must rely on the principles of separation of functions and powers of various state bodies, as provided by the Constitution.
As noted by the representatives of the agency, oversight of the legality of investigations into criminal cases conducted by investigative units such as the GKNB and the Ministry of Internal Affairs is entrusted to the prosecutor's office, while judicial authorities are responsible for justice. The press service referred to the criminal procedural legislation, which states that sentences and other court decisions can only be reviewed by the relevant judicial instances in the manner established by the Criminal Procedure Code of the Kyrgyz Republic (CPC KR).
“According to Article 8 of the CPC KR, procedural decisions of the investigator can only be checked and canceled by the supervisory authority,” they added. In this regard, the proposal to create a commission to review criminal cases contradicts the fundamental principles of the Constitution, as interference in investigative and judicial activities is prohibited by law, the GKNB stated.
Furthermore, the agency mentioned that in accordance with the directives of President Sadyr Japarov, a reform is currently being implemented in the GKNB that encompasses almost all aspects of its activities.
“The reform aims to adapt national security agencies to modern challenges and threats, improve work in the field of intelligence and counterintelligence, combat terrorism and extremism, as well as eradicate corruption and curb organized crime, with the goal of ensuring the informational and economic security of the country,” the press service assured, adding that the GKNB adheres to legal frameworks and “respects the rights and freedoms of citizens.”
