The deputy fears that the institution of private bailiffs may turn into a business

Ulukbek Uzakbaev, a deputy of the Jogorku Kenesh, expresses concern about the introduction of the institute of private bailiffs, which, in his opinion, may lead to the commercialization of state functions.

At the meeting on February 24, the committee on judicial and legal issues plans to discuss a draft law concerning enforcement proceedings, which proposes the introduction of private bailiffs with expanded powers.

“This is a significant reform; however, society is not sufficiently informed about its essence. With the establishment of the institute of private bailiffs, the General Prosecutor's Office receives expanded powers, which carries certain risks,” noted the deputy.

Umutkan Konkubaeva, the Deputy Attorney General, reminded that the introduction of this institute became possible thanks to the decree of President Sadyr Japarov.

“The creation of the institute of private bailiffs does not pose a threat. We studied the experience of neighboring countries where such practices already exist. Citizens will be able to choose between state and private bailiffs. This, on the contrary, is aimed at improving the situation for the population,” she commented.

Uzakbaev emphasized that the transfer of certain functions, such as arrest and travel restrictions, to private bailiffs raises concerns for him.

“This draft law transfers important powers to private individuals. Although it specifies the qualification requirements for private bailiffs, I insist on the need for stricter control to avoid turning this process into a commercial venture,” added the deputy.

Konkubaeva agreed with his opinion, noting that the prosecutor's office will ensure strict oversight. “For example, we have established an age limit of 25 years for employees, whereas the usual requirement for state service is 21 years,” she noted.

“This is the first time in history that such functions are being transferred to private organizations. This has not been practiced before,” added the deputy.

She also reminded that a similar practice was introduced last year when the Ministry of Justice transferred certain powers to private notaries within the framework of summary proceedings.

“But notaries do not have the authority to arrest bank accounts,” clarified the deputy.

Konkubaeva assured that the oversight of compliance with legislation by private bailiffs will be conducted strictly.
