This resolution, adopted on February 19, 2026, will come into effect ten days after its official publication.
Payment for Notarial Services through an Electronic Platform
According to the new regulations, the state duty for each notarial action must be paid on the day the notarial action is performed, through a system integrated into the UISN. Information about the payment will be stored in the system and serve as confirmation of the payment. Additionally, the text of the notary's certification inscription must now be generated exclusively through this system.Personal Procedure for Executing Significant Agreements
The amendments require that a number of social agreements be executed only in person. Conclusion of such documents through representatives is not permitted.Such agreements include:
- marriage contract;
- surrogacy agreement;
- agreement on the transfer of a child to a foster family;
- lifelong maintenance agreement;
- perpetual rent agreement;
- alimony agreement;
- agreement on the exercise of parental rights.
Changes in the Procedure for Children Traveling Abroad
The procedure for obtaining consent for minors to leave the country has also been changed.Now, the consent of parents, adoptive parents, guardians, or custodians for a child to travel unaccompanied or to reside permanently abroad with one of the parents or guardians will be issued only for a specified period.
Clarified Requirements for Notarial Orders
The new document details the requirements for issuing notarial orders depending on the grounds for collection, which concern:- notarized transactions;
- transactions in simple written form;
- protests of promissory notes;
- alimony for minor children (in the absence of a dispute over paternity or maternity);
- mandatory payments (excluding taxes and insurance contributions);
- accrued but unpaid wages.
Notification of Debtors via Messengers
The procedure for notifying debtors about the issuance of notarial orders has been changed.As before, a copy of the order must be sent no later than the following day after its issuance; however, now the notary can use:
- mail with acknowledgment of receipt;
- email in PDF format;
- messengers WhatsApp, Viber, and Telegram;
- personal messages.
Continuation of Digitalization of Notarial Services
The Ministry of Justice noted that digital notarial services have previously been implemented in the country, including:- remote notarial actions for citizens of Kyrgyzstan abroad through the "Electronic Notary" system;
- remote execution of certain notarial actions;
- pilot launch of the "Electronic Apostille" system with a full online cycle;
- increased qualification requirements for private notaries in inheritance matters;
- expansion of international cooperation in notarial services.
