Minister of Justice on Frequent Amendments: Even the Ministries Themselves Can't Keep Up with the Changes

At the meeting of the committee on judicial and legal issues of the Jogorku Kenesh, Aiaz Bayetov, the Minister of Justice, emphasized that the frequency of changes in the codes has become so high that even government authorities do not always manage to keep track of them.

The committee discussed a draft law on January 20, which implies limiting amendments to the codes to no more than once a year - a proposal that sparked discussions among the deputies.

Some deputies expressed dissatisfaction, arguing that such a measure could undermine the essence of legislation and limit the powers of parliament.

Bayetov noted that establishing a limit on changes to the codes is an important practice necessary for maintaining the stability of the legislative framework and effective long-term planning in the economy and social sphere. The minister provided statistics: last year, the Code on Offenses was amended 33 times, with half of the amendments initiated by deputies and the other half by the government.

The minister also reminded that in 2024, parliament adopted a resolution on the need to implement tools that promote the stability of legislation. According to this document, if a law is amended more than six times within a year, it should be considered unstable.

Deputy Attorney General Umutkan Konkubaeva supported the draft law from the Ministry of Justice, calling it the right decision.

She emphasized: "There have been cases where articles were added to the Criminal Code for which no cases were initiated, as the real situation was different. I have always said that it is necessary to conduct an analysis over five years before introducing a new article into the code to understand all the causes of the problem. Recently, changes have been made under the influence of emotions and media materials," Konkubaeva added.
