
The Military Prosecutor's Office of Kyrgyzstan (KR) sees the need to establish a Military Investigative Committee (MIC) — a specialized operational-investigative unit. This prosecutor's office oversees the actions of the Armed Forces, internal troops, national security agencies, and border services. It is important to note that for the detention of criminals and suspects or for conducting investigative activities, the prosecutor's office often has to seek assistance from the Ministry of Internal Affairs and the Ministry of Defense.
For example, during the detention of a suspect in a criminal case initiated by the Military Prosecutor's Office, forces from the Ministry of Internal Affairs or military special units are often involved. In cases where clarification of information about crimes related to cyber technologies is required, the prosecutor's office turns to the State Committee for National Security (SCNS) for assistance, as they have a relevant cybersecurity unit.
This highlights that the Military Prosecutor's Office faces a lack of necessary operational, power, and technical resources for conducting investigations and pre-investigation checks, as well as for searching for and detaining criminals. By turning to other law enforcement agencies, the prosecutor's office risks encountering leaks of confidential information and potential conflicts of interest, especially in cases involving investigations of SCNS employees or military personnel with access to specialized resources.
The establishment of the Military Investigative Committee (MIC) will significantly enhance the effectiveness of the Military Prosecutor's Office by providing them with an independent mechanism for conducting investigations and their own special forces. The structure of the MIC will include the following departments:
The Operational Department, responsible for searching for and detaining suspects. The Special Technical Investigation Department (including cybersecurity and modern surveillance technologies). The Special Operations Department (special forces). The External Surveillance Department. The Expert-Criminalistic Department. The Personnel Selection Department. The Secretariat.
The leadership of the MIC will consist of a Director and two deputies, who will be provided with state protection. The appointment of the Director and his deputies will occur by decree of the President of the KR based on the recommendations of the Attorney General and the Military Prosecutor of the KR. The MIC will be funded from the republican budget.
The selection of candidates for the MIC staff will be conducted jointly with the Military Prosecutor's Office and the Main Intelligence Directorate (military intelligence) of the KR. Candidates may include active military personnel, graduates of military educational institutions, and officers with experience in operational structures of the Armed Forces and army special units. The establishment of the Military Investigative Committee will ensure full and effective functioning within the framework of the Military Prosecutor's Office of the KR.
