In his submission, the president emphasizes that the existing provisions of the Law "On the Constitution of the Kyrgyz Republic," adopted in a referendum on April 11, 2021, give rise to disagreements and allow for ambiguous interpretations of the terms of office of the president elected under the previous version of the Constitution from June 27, 2010.

The current legal positions expressed by various lawyers and public figures indicate the emergence of uncertainty in constitutional law, which is critical for the stable functioning of state institutions.

According to the provided information, such uncertainty affects the foundations of the constitutional order, the principles of popular sovereignty and the rule of law, as well as the regulation of elections in accordance with the Constitution and the laws of the country, impacting the electoral rights of the citizens of Kyrgyzstan.

The president emphasizes that the continuation of existing discrepancies in the context of high public sensitivity to issues of power may lead to political confrontation and undermine public trust in state institutions, creating risks for the legitimacy of government decisions and increasing social tension. There is also a noted threat of disputes regarding the actions of bodies responsible for preparing and conducting elections and referendums.

In order to eliminate legal uncertainty and prevent a possible constitutional crisis, as well as to maintain citizens' trust in state institutions and ensure the stability of the electoral process, the President of Kyrgyzstan requests:

— An official interpretation:

— of Article 67, the second paragraph of part 2 of Article 68, part 1 of Article 72 of the Constitution of the Kyrgyz Republic (as amended by the Law of May 5, 2021) in their interrelation with the relevant norms of the Constitution (as amended by the Law of June 27, 2010) and the provisions of the Law "On the Constitution of the Kyrgyz Republic," adopted in a referendum on April 11, 2021;

— the procedure and timelines for holding regular or early elections for the President of the Kyrgyz Republic.

This appeal will be considered by the Constitutional Court on February 17 as a priority under the written procedure.
