The deputy proposes changes to the law regarding the conduct of peaceful rallies

Deputy Kubanychbek Samakov has proposed an initiative to amend the law concerning peaceful assemblies. The draft law is already available on the website of the Jogorku Kenesh for public discussion.

According to the initiator, the aim of the developed draft law is to protect the rights of citizens who do not participate in rallies, as well as to ensure public order and safety, protect the health and moral values of society, and safeguard property.

Samakov reminded that according to the Constitution, everyone has the right to freely assemble peacefully, and no one can be forced to participate in such an event. To organize a peaceful assembly, it is necessary to notify state authorities or local self-government.

In his opinion, this right, which is associated with freedom of speech and expression of opinions, can lead to protests that disrupt public order. "The freedom of assembly must take into account the rights and interests of citizens who do not participate in events. The state is obliged to care for the safety of all citizens. Citizens who do not participate in rallies also have the right to life and protection of their property, and they must be assured that they will not face threats from others," emphasized the deputy.

According to the Ministry of Internal Affairs, from 2020 to 2023, there were 3,740 assemblies in the republic, including 1,727 in Bishkek. Additional law enforcement forces were involved to ensure safety during the rallies.

Thus, there is a need to pre-determine specially designated places and routes for peaceful assemblies.

Samakov also reminded that according to current legislation, state authorities and local governments do not have the right to determine the time and places for peaceful assemblies, nor to impose restrictions on movement routes.

The initiator believes that the ability to designate places and routes for peaceful assemblies will help prevent social conflicts and protect legally protected values, as well as contribute to the observance of citizens' rights and ensure the safety of society and the state.

It is worth noting that the Pervomaisky District Court of Bishkek has prohibited the holding of rallies in the city center, allowing actions only in the territory of the M. Gorky Park.
