It is important to note that a new Land Code was adopted in 2025, under which garden and summer cottage plots were classified as lands of populated areas with the intended purpose of "housing construction." However, there have been no unified rules for their application until now, leading to confusion and difficulties in defining boundaries, as well as contributing to the non-target use of land.
The proposed project aims to establish clear boundaries for such territories. Special commissions operating under local administrations will handle this, based on decisions regarding the allocation of plots made before June 16, 1999.
After determining the boundaries of public lands, it is planned to transfer responsibility to local self-government bodies, while plots occupied by transformer substations and power lines will be assigned to relevant energy companies.
Additionally, the document separately addresses the issue of ownerless plots. If a plot has no registered owner and is free from third-party rights, it will be considered ownerless property under the Civil Code. At the same time, such territories will remain residential areas, retaining the names of gardening associations.
The Cabinet hopes that the adoption of these rules will allow:
- to streamline urban planning documentation;
- to increase the efficiency of land use;
- to create favorable conditions for infrastructure development and improvement.
