As part of the new regulation, the use of automated information systems for providing public services is envisaged.
This project implements the provisions of the Cabinet of Ministers' resolution dated March 3, 2023, No. 115, according to which certain legislative powers were delegated to the Land Agency.
The agency emphasizes that the current regulation, which came into force in 2009, has become outdated and does not meet modern digitalization requirements.
The updated version of the document aims to improve the transparency of procedures, reduce administrative barriers, and simplify the interaction of citizens with government bodies.
According to the justification, the adoption of the new regulation will not lead to social, economic, legal, environmental, or corruption-related consequences and will not require additional expenditures from the republican budget.
According to the new Regulation, technical inspection includes initial (for newly created objects) and current inspection (in the case of reconstruction, re-planning, re-profiling, or at the initiative of the rights holder). The result of the inspection is a technical passport, which is issued on a paid basis and is available in both paper and electronic formats, with mandatory placement in the electronic archive of the registration system.
Key changes:
- The possibility of submitting applications and documents online through the State Electronic Services Portal;
- A clear definition of requirements for field and desk work, measurements, plans, and area calculations;
- Established procedures for interaction with unauthorized constructions, as well as with local self-government bodies and architectural and construction supervision;
- Introduced deadlines for suspension (up to 30 days in case of lack of access to the object) and grounds for refusals;
- For complex and large objects, inspections may be conducted on a contractual basis;
- Strengthened control over the quality of measurements within the organization.
The technical passport contains plans of the land plot and buildings, floor plans, structural characteristics, and area calculations. A new passport is issued if the parameters of the object change. This document is not a title document.
