This draft was developed by the State Agency for Land Resources, Cadastre, Geodesy, and Cartography with the aim of adapting subordinate legislation to the updated Land Code.
Within the framework of the document, it is proposed to establish the following norms:
- standards for compensation for losses during the transformation of agricultural land;
- standards for compensation when agricultural land is provided without transformation — for the needs of subsoil use and infrastructure construction.
According to the draft, funds received as compensation will be directed towards the development of new lands, land reclamation, improving soil fertility, and project survey work.
The document also describes the procedure for calculating lost profits. In particular, the following compensation amounts are proposed:
- 1,760 soms per hectare of irrigated arable land with perennial crops;
- 610 soms for rainfed arable land and fallow;
- 350 soms for hayfields;
- 90 soms for pastures.
The amount of compensation will be calculated taking into account a coefficient of 99. In the case of land allocation for subsoil use, the duration of the license or its extension specified in the permitting documents will be used instead of the coefficient.
Additionally, the draft provides for a mechanism to monitor the inflow of funds into the republican and local budgets when land is transferred or used for subsoil use.
