Factories near homes? A new bill allows for forced demolition

On the official website of the ЖК, a draft law has been published that proposes changes to existing legislative acts. The new bill implies the introduction of a legal institution known as a specially protected construction zone (СОЗЗ).

According to this document, zones will be created where industrial activities may be restricted or completely prohibited if they pose a threat to the life and health of citizens or harm the environment. СОЗЗ can be established in populated areas and adjacent territories where residential buildings, schools, medical institutions, recreational areas, and agricultural lands are located.

One of the conditions for introducing the СОЗЗ regime will be the presence of at least two confirmed cases of exceeding permissible norms for emissions of hazardous substances, noise levels, deterioration of road conditions due to heavy machinery, or the absence of wastewater recycling systems at the enterprise. In such areas, it will be prohibited to build and expand enterprises that may exacerbate the negative impact.

It is planned to supplement the land code with a provision allowing for the expropriation of land plots and the demolition of facilities located within the СОЗЗ to eliminate ecological threats.

Owners will be able to avoid expropriation if they agree to modernization and the implementation of modern technologies during a transitional period, which lasts up to two years with the possibility of extension for another year.

The draft also includes a mechanism for providing equivalent land plots in industrial zones for the relocation of production facilities.

The explanatory note to the draft law states that these changes are intended to prevent urban planning conflicts, reduce harmful impacts on public health, and protect residential areas from uncontrolled industrial effects.
