Today, March 3, the law enforcement committee held the second reading of amendments to various codes that strengthen penalties for driving under the influence of alcohol.

The proposed changes concern the Criminal and Criminal Procedure Codes, the Code of Offenses, and the Law "On Road Traffic":

The first reading of the bill's concept took place on January 15 and was approved by parliament.

Deputy Dastan Bekeshev put forward a number of proposals, including limiting the grounds for the forced towing of vehicles.

He noted that residents of the "Kok-Zhar" microdistrict complain about the towing of vehicles even in the absence of no-parking signs and questions whether his proposals have been considered.

Deputy Interior Minister Oktay Urmambetov confirmed that the proposal has been accepted.

Bekeshev also suggested posting information about towed vehicles not only on the GUOBDD website but also in mobile applications such as "Tunduk" or "My City." Urmambetov agreed with this proposal.

Additionally, the deputy raised the issue of clearly defining the state of alcohol intoxication. He emphasized the need to establish a permissible blood alcohol limit in the law.

"How can we determine if a person is in a state of alcohol intoxication? For example, they drank yesterday and are sober today, but they may still smell of alcohol. Or a person drank a week ago, and traces of alcohol are still in their blood," Bekeshev noted.

He also added: "Sometimes even kefir can show the presence of alcohol, even though you are not drunk. There are cases where medications or specific odors, for example, in people with diabetes, can be perceived as alcohol intoxication."

Bekeshev emphasized that the wording "in a drunken state" in the code requires clarification.

Suyunbek Omurzakov, the chairman of the education committee, noted that it is possible to distinguish between a drunk and a sober person without tests. However, Bekeshev reminded about the severe penalties provided for in the bill, which can reach 80,000 soms, and the revocation of rights is also a serious consequence. Therefore, defining the blood alcohol limit in the law is extremely important.

Moreover, Bekeshev proposed to include this norm in the notes to the law, as he believes that many drivers may not be aware of the new rules.

The deputy also expressed the need to separately regulate the status of scooter and electric scooter drivers so as not to equate them with pedestrians. A representative of the Ministry of Internal Affairs agreed that this proposal would be taken into account.

Another topic for discussion was the legal registration of illegally imported mopeds. Bekeshev pointed out that many of them were registered with a reduced engine capacity and suggested allowing their legalization with subsequent registration.

The director of the State Center for Vehicle Registration and Driver Training, Tynychbek Saidov, stated that the center would implement the corresponding decision if it is adopted. Urmambetov added that the proposal would be considered further.

Bekeshev expressed dissatisfaction that his proposals were submitted a month ago, and responses have still not been provided.

Deputy Bolotbek Borbieyev noted that the blood alcohol limit should remain at the level of a resolution, as special equipment is required to determine the level of alcohol in the blood, which the Ministry of Internal Affairs does not have.

"Yes, the Ministry of Internal Affairs is not ready yet. Therefore, we are working within the framework of a resolution. Previously, deputies raised questions about determining the level of alcohol after consuming bozo or kumys. Special equipment is also required for this," agreed the deputy head of the Ministry of Internal Affairs.
