
For eight years, a child with a disability did not receive the assistance she was entitled to due to a bureaucratic error
A girl living in an orphanage in the Chui region has been deprived of state support for disability for eight years. The Ombudsman Institute, focusing on children's rights, was able to restore her rights.
According to the press service of the Ombudsman, the violation was discovered during a monitoring of children's institutions in the Chui region in 2025. While checking living conditions and the rights of orphans, the institute's staff found that some children were not receiving the benefits they were entitled to.
M.B., born in 2008, has been living with her sister in an orphanage since 2017 after the death of their parents. The girl's disability was established by the Medical and Social Expert Commission (MSEC) in 2015, which also assigned her a benefit and recommended inclusive education.
However, upon her transfer to the orphanage in 2017, the payments were stopped because the girl did not undergo a re-examination by the MSEC. In turn, the administration of the institution and the responsible services did not organize the re-examination, which led to the benefit not being paid for eight years.
Ombudsman Jamilya Jamambaeva appealed to the General Prosecutor's Office and the Ministry of Labor, Social Protection, and Migration demanding the restoration of the girl's rights and the payment of the overdue funds.
As a result of the investigation, the Ministry of Labor took disciplinary action against the employees who made the error and restored the benefit for the girl from 2017 until May 1, 2026. A total of 518,000 soms will be transferred to her deposit account.
Representatives of the Ombudsman Institute emphasized that the responsibility for protecting the rights of children, including orphans, lies with government bodies and local authorities.
