Cancellation of service charge in cafes and restaurants: authorities explained the reason for the decision

The authorities have decided to abolish the service charge in cafes and restaurants based on numerous complaints from consumers who are dissatisfied with the additional 15% fee added to the price of dishes. This was reported by Adilet Jumabekov, a leading specialist in the antimonopoly policy department of the Ministry of Economy, during a broadcast on "Birinchi Radio."

He noted that, at the direction of the presidential administration, a draft amendment to the legislation was developed. During discussions, various proposals and comments were made by restaurateurs and entrepreneurs, which led to a postponement of the implementation of the new rules. As a result, the new regulations will come into effect on January 1, 2026.

Ruslan Kazakov, head of the consumer rights protection department of the Antimonopoly Regulation Service under the Ministry of Economy and Commerce of the Kyrgyz Republic, added that in the public catering sector, there is a public offer where the menu essentially acts as a contract. A visitor can either agree to the stated price or refuse the order.

According to the current trading rules, establishments have the right to set prices independently. However, adding service percentages to the price stated in the menu is now considered an offense and will result in administrative liability. All costs, including staff wages, must be included in the final price of the dish stated in the menu.
