Deputy fears: Will those responsible for fatal road accidents stop paying compensation to the victims?

The discussed legislative proposal suggests removing the provision that allows probation to be applied in cases related to fatal traffic accidents. Deputy Gulsunkan Junushalieva warns that this may negatively impact the situation of the victims.

She emphasized that currently, the court takes into account mitigating circumstances if the perpetrator of the traffic accident has made compensation payments and received forgiveness from the relatives of the deceased.

The deputy also expressed doubt: "According to the proposed changes, the perpetrator of a fatal traffic accident could face up to 12 years in prison. Will this not lead to perpetrators simply stopping compensation payments to the victims?"

Deputy Head of the Ministry of Internal Affairs Oktay Urmambetov clarified that if a traffic accident resulting in one death was committed through negligence and the perpetrator was not under the influence of alcohol, the possibility of reconciliation between the parties and the application of probation remains.

He specified: "This draft law primarily focuses on cases where two or more people have died as a result of a traffic accident or if the accident occurred under the influence of alcohol. In such situations, probation is not applied. The perpetrator must acknowledge their responsibility. The decision on compensation for the victims will be made by the court and will be mandatory for execution," the deputy minister added.
